The Dispute Review Board (DRB) process is used on projects that have incorporated the Special Provision for Dispute Review Board. All projects that do not have the Special Provision for Dispute Review Board shoudl follow the regular MDOT Construction Contractor Claims Procedure
The DRB Special Provision should be included on projects according to its Use Statement. An exception to remove the DRB SP can be requested by the managing office with concurrence from the Region Engineer. This request must be prior to letting and is to be provided to a panel of the following individuals: the DRB Program Administrator, The Engineer of Construction Field Services, and the Bureau of Field Services Director. This panel will make the final department decision regarding inclusion or removal of the DRB Special Provision. The DRB Special Provision shall not be removed from the contract after letting.
The DRB Procedures describe the MDOT procedures for submittal and review of Contractor claims using a Dispute Review Board (DRB). For more information, please refer to the Dispute Review Board folder in ProjectWise. It is located under the following path: MDOTProjectWise\Documents\External Partnerships\Dispute Review Board (DRB).
The ProjectWise folder includes the current MDOT DRB Procedures, DRB Agreement, Special Provision, and the approved DRB candidate list. It also contains individual folders for each DRB candidate used to store and update their DRB application and resume. All ProjectWise users have access to these documents to assist in the selection, review, and approval of potential DRB panel members.
