This DRB Procedured describes the Michigan Department of Transportation (MDOT) procedures for submittal and review of Contractor claims and Contractor performance evaluation appeals using a Dispute Review Board (DRB).  The Dispute Review Board (DRB) process is used on projects that have incorporated the Special Provision for Dispute Review Board.  The DRB process is used on Contractor claims and Contractor performance evaluation appeals as described within.

The DRB Special Provision should be included on projects according to its Use Statement. An exception to remove the DRB SP can be requested by the managing office with concurrence from the Region Engineer. This request must be prior to letting and is to be provided to a panel of the following individuals: the DRB Program Administrator, The Engineer of Construction Field Services, and the Bureau of Field Services Director. This panel will make the final department decision regarding inclusion or removal of the DRB Special Provision. The DRB Special Provision shall not be removed from the contract after letting.
