Dust Control

Dust control is very important, especially during the earthwork phase of construction. Adequate dust control measures will be maintained by the Contractor so as not to cause detriment to the safety, health, welfare or comfort of any person, or cause damage to any property, residence or business. If not shown as a pay item, dust control will be at the Contractor's expense.

Disposal of Contaminated Non-Hazardous and Hazardous Materials

Specific requirements regarding disposal of Contaminated Non-Hazardous and Hazardous Material will be listed in the applicable pay item specification. Common materials requiring disposal include, but are not limited to:

  • Spent Abrasive – Section 715. Cleaning and Coating Existing Structural Steel
  • Non Hazardous Contaminated Material Handling and Disposal – Special Provision
  • Contaminated Groundwater Dewatering and Treatment – Special Provision

Specifications generally require the Contractor to characterize the material, choose the disposal site, provide the Department receipt of disposal, and complete all documentation required by the landfill.

Construction staff are reminded to carefully review forms and documents prior to signing. MDOT construction staff are not authorized signatories for the Director and cannot enter an agreement or contract for the Department. Some landfills and waste disposal sites have indemnification and liability language on their waste manifest and waste characterization forms. The Department cannot provide legal protection for staff who sign these agreements or contracts, therefore, MDOT staff are not authorized to sign any manifest or documentation that includes indemnification clauses. It is the responsibility of the Contractor to sign these documents and provide a copy to the Engineer.

MDOT construction staff should contact Construction Field Services prior to signing any document where there is a concern about language on the document.

Two optional forms have been created which may be used by the Contractor, at their request:

  • Form 1095 is only to be used when disposing Hazardous Material.
  • Form 1096 is only to be used for disposal of Non-Hazardous Contaminated Material
